Eligibility Requirements: U.S. Citizenship

✓ Age:

  •  You must be at least 18 years old when you file your N-400 application. This is a requirement regardless of whether you are applying based on 5 years of permanent residency or 3 years through marriage to a U.S. citizen.

✓ Permanent resident status:

  • You must have been a lawful permanent resident (green card holder) for at least 5 years. If your spouse is a U.S. citizen, you may apply after 3 years of being a permanent resident. However, you must have been living with your U.S. citizen spouse during that time.

✓ Continuous Residence:

  • Continuous residence means that you have maintained your primary residence in the U.S. for the required period. 

   If you have traveled outside the U.S., any single trip that lasts 6 months or longer may disrupt your continuous residence unless you can prove otherwise. Trips of less than 6 months usually do not break continuous residence.

✓ Physical Presence:

  • You must be physically present in the U.S. for at least half of the required residency period: 
  •      30 months for applicants applying based on 5 years of residency.
  •      18 months for applicants applying based on marriage to a U.S. citizen.
  •    Physical presence means you must have been physically in the U.S. during that time.

✓ Good Moral Character:

  • You must demonstrate good moral character for the required period prior to applying for naturalization. Factors that can affect this assessment include criminal history, payment of taxes, and other legal obligations.

   USCIS generally looks back at your moral character for 5 years before filing (3 years if applying based on marriage to a U.S. citizen).

✓ English Language:

  • You must have a basic understanding of English. This includes the ability to read, write, and speak the language. There are exceptions for older applicants (age 50 or older when applying) or those who have lived in the U.S. for a certain period and have a medical disability.

✓ Civics Knowledge:

  • You must pass a civics test which covers U.S. history and government. The test consists of 100 questions, but you only need to answer 6 of 10 questions correctly during the interview.
  •    There are resources available to help you study for this test on the USCIS website.

✓ Oath Of Allegiance:

  • You must be willing to take the Oath of Allegiance, which includes pledging loyalty to the United States and renouncing any allegiance to other countries.

  • Application Fees: There is a fee associated with filing the N-400, which can change, so check the USCIS website for the current fee amount.
  • Supporting Documents: You will need to provide various documents with your application, such as a copy of your green card, passport photos, and proof of residency.
